End User License Agreement (EULA)
This End User License Agreement governs your licensed use of the Surf Live Score mobile app as software. It should be read together with our Terms and Conditions and Privacy Policy.
This End User License Agreement ("EULA") is a legal agreement between you and LOUD srl ("LOUD", "we", "us", or "our") for the mobile application Surf Live Score (the "App"). By installing, accessing, or using the App, you agree to this EULA. If you do not agree, do not install or use the App.
1. Licence grant
Subject to this EULA, the Terms and Conditions, and applicable law, LOUD grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on iOS devices that you own or control.
The licence is for personal, non-commercial, and internal informational use only. The App is currently built for iPhone and iOS, including related iOS features such as widgets and notifications.
2. Restrictions
You may not, and you may not allow anyone else to:
- Copy, modify, adapt, translate, or create derivative works from the App, except as permitted by law.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Remove, alter, or obscure copyright, trademark, or proprietary notices.
- Sell, rent, lease, lend, sublicense, distribute, or transfer the App or any rights in the App.
- Use the App, API, or related pages to scrape, overload, disrupt, or compromise our infrastructure.
- Use the App for unlawful, fraudulent, harmful, or unauthorised purposes.
- Represent the App as an official World Surf League, athlete, event, or platform service.
3. Ownership and intellectual property
The App, including its code, interface, design, original graphics, original text, app icon, and related documentation, is owned by LOUD srl or its licensors and is protected by intellectual property laws.
This EULA does not transfer ownership of the App to you. All rights not expressly granted are reserved by LOUD and its licensors. Third-party names, trademarks, event names, athlete names, images, and sports data remain the property of their respective owners.
4. Sports data, preferences, and app content
The App displays public sports information, including surf event schedules, rankings, athlete names, athlete images, public athlete profile details, event status, historical results, and related links.
You may configure local preferences such as selected season, language fallback, notification state, widget data, and favourite athletes. Where the App or API processes information you provide or generate through use of the App, you grant LOUD a limited licence to process that information only as needed to operate, maintain, secure, and improve the App, subject to the Privacy Policy.
5. Third-party services and components
The App may rely on or link to third-party services, including Apple services, Firebase, Google Cloud, notification infrastructure, Instagram, YouTube, World Surf League related pages, and hosting or email providers.
Your use of third-party services is subject to their own terms and privacy policies. LOUD is not responsible for third-party availability, content, accuracy, security, or practices. The App may also include open-source or third-party software components governed by their own licences.
6. Updates and changes
LOUD may provide updates, patches, new versions, or feature changes. Updates may be required for some features to work correctly. We may also modify, suspend, or discontinue features, data sources, widgets, notifications, or API routes at any time.
This EULA applies to updates and new versions of the App unless a different licence is provided with a specific update.
7. Support and maintenance
LOUD may provide support at its discretion through the contact channels listed below. Unless required by law or by a separate written agreement, LOUD has no obligation to provide a particular support level, uptime, response time, or maintenance service.
8. No warranty
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise.
LOUD does not warrant that event schedules, rankings, countdowns, athlete profiles, notifications, widgets, or other information will be accurate, complete, uninterrupted, real time, secure, or error-free.
9. Limitation of liability
To the maximum extent permitted by law, LOUD srl, its directors, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, missed events, delayed notifications, or reliance on inaccurate sports information.
Where liability cannot be excluded by law, LOUD's total liability will be limited to the greater of the amount you paid to use the App during the twelve months before the event giving rise to the claim or one (1) euro.
10. Export control and sanctions
You represent that you are not located in a country or territory subject to applicable comprehensive sanctions or embargoes, are not listed on a government list of prohibited or restricted parties, and will not use or export the App in violation of applicable export control or sanctions laws.
11. Termination
This EULA remains effective until terminated. You may terminate it by stopping use of the App and deleting it from your devices. LOUD may terminate this EULA or suspend access to the App if you breach this EULA, if your use creates risk or liability, if required by law, or if the App is discontinued.
Upon termination, the licence granted to you ends immediately and you must stop using the App. Sections that by their nature should survive termination will continue to apply.
12. Apple App Store specific terms
If you obtain the App from the Apple App Store, the following terms also apply:
- This EULA is between you and LOUD srl, not Apple.
- Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App and is not responsible for claims, losses, liabilities, damages, costs, or expenses arising from any failure of the App to conform to any warranty.
- Apple is not responsible for addressing claims relating to the App or your possession and use of the App, including product liability, legal compliance, consumer protection, privacy, or intellectual property claims.
- You must comply with applicable third-party terms when using the App.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce this EULA against you as third-party beneficiaries.
13. Privacy
The processing of personal data and technical information is described in our Privacy Policy. By using the App, you acknowledge that information may be processed as described there.
14. Governing law and jurisdiction
This EULA is governed by the laws of Italy, without regard to conflict of law principles. Any dispute arising out of or in connection with this EULA or the App will be subject to the exclusive jurisdiction of the courts of Brescia (Italy), to the extent permitted by applicable law.
15. Language and translations
This EULA is provided in English. Any translations are provided for convenience only. If there is a conflict between the English version and a translation, the English version will prevail.
16. Miscellaneous
This EULA, together with the Terms and Conditions and Privacy Policy, is the agreement between you and LOUD regarding the licensed use of the App. If any provision is invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
You may not assign this EULA without LOUD's prior written consent. LOUD may assign this EULA as part of a business transfer, reorganisation, or by operation of law.
